By purchasing artwork through cgaspar.art, you agree to the following terms.
1. All Artwork is Original
Every work sold through this site is an original, handmade work of art created by C.I. Gaspar. Limited edition prints are produced from original works under the direct supervision of the artist, signed and numbered by hand. Open edition prints are high-quality archival reproductions of original works.
2. Descriptions and Images
All reasonable effort is made to accurately represent each work through photography and written description. Due to variations in screen calibration, colors may appear slightly different on your device than in person. If accurate color representation is critical to your purchase, please inquire before buying.
3. Pricing
All prices are listed in US Dollars (USD). Prices include the artwork only — framing, shipping, insurance, and any applicable taxes or duties are additional unless explicitly stated otherwise.
4. Payment
Payment is processed securely through Stripe. We accept major credit cards and debit cards. For original works priced above $5,000, purchases may be structured as a 50% deposit to reserve the work, with the remaining balance due before shipping. Deposits are non-refundable once the work has been reserved and removed from availability.
5. Sales Tax
Texas sales tax will be collected on orders shipped to Texas addresses, as required by law. For orders shipped to other US states, applicable sales tax will be collected where required. International orders are not subject to US sales tax but may be subject to import duties, VAT, or customs fees in the destination country (see Shipping Policy).
6. All Sales Are Final
Due to the unique, one-of-a-kind nature of original artworks and limited editions, all sales are final. We do not accept returns or offer refunds except in the case of damage during shipping (see Shipping Policy, Section on Damage Claims).
7. Authenticity
Every original work and limited edition print sold through cgaspar.art comes with a Certificate of Authenticity signed by the artist. This certificate includes: the title of the work, date of creation, medium, dimensions, edition number (if applicable), and a unique identifier.
8. Reproduction Rights
The purchase of an artwork does not transfer copyright or reproduction rights. The artist retains all copyright and reproduction rights to all works. The buyer may not reproduce, photograph for commercial use, or create derivative works without written permission from the artist. Personal, non-commercial photography of the work in your own space (including social media posts) is welcome and encouraged.
9. Resale
The buyer may resell the work at any time. As a courtesy, we ask that the artist be notified of any resale so provenance records can be updated. The artist reserves the right to exercise Artist Resale Rights where applicable by law.
10. Privacy
We take collector privacy seriously. Your personal information is used solely to process your transaction and ship your artwork. We do not sell, share, or disclose buyer information to any third party. Buyer names are never publicly associated with specific works unless the buyer provides explicit written consent. 11. Anonymous Purchases
We welcome anonymous purchases. Buyers may complete transactions without providing a name — only a shipping address and payment method are required. For anonymous purchases, all communications will be conducted through the email address or contact method provided at checkout. The same terms of sale, authenticity guarantees, and damage claim processes apply to anonymous purchases.
12. Disputes
Any disputes arising from a purchase will be resolved through good-faith communication between the buyer and the artist. If a resolution cannot be reached, disputes will be governed by the laws of the State of Texas, with venue in Travis County, Texas.
13. Limitation of Liability
The artist's total liability for any claim related to a purchase shall not exceed the purchase price of the artwork in question. The artist is not liable for any indirect, incidental, or consequential damages.
