Buyers Agreement

This agreement applies to purchases over $2,000. By completing your purchase, you confirm that you have read, understood, and agreed to all terms below.
This agreement is between C.I. Gaspar (“the Artist”) operating as cgaspar.art, and the Buyer identified by the payment method and/or shipping information provided at the time of purchase (“the Buyer”).
1. Authorization
The Buyer confirms that they are the authorized holder of the payment method used for this transaction, or that they have explicit authorization from the cardholder to make this purchase. The Buyer understands that unauthorized use of a payment method constitutes fraud and may be prosecuted.
2. Agreement to Purchase
The Buyer confirms that this purchase is intentional and voluntary. The Buyer has reviewed the artwork description, images, dimensions, medium, condition notes (if any), and pricing before completing the transaction. The Buyer understands that original artworks are unique objects and that minor variations from photographs are inherent to handmade work.
3. Non-Refundable Transaction
The Buyer acknowledges that all sales of original artwork and limited edition prints are final and non-refundable, except in the case of verified shipping damage as described in the Shipping Policy. Deposits on works priced above $5,000 are non-refundable once the work has been reserved.
4. Chargeback and Dispute Policy
The Buyer agrees to contact the Artist directly at studio@cgaspar.art to resolve any concerns or issues before initiating a chargeback or payment dispute with their financial institution. The Buyer acknowledges that initiating a chargeback or payment dispute without first attempting to resolve the issue directly with the Artist may constitute a breach of this agreement.
If a chargeback is filed after the artwork has been shipped and delivered (as confirmed by tracking and signature), the Artist reserves the right to:
- Contest the chargeback with all available documentation, including this signed agreement, tracking information, delivery confirmation, and transaction records
- Pursue recovery of the artwork and/or the purchase amount through legal channels
- Report the incident to applicable fraud prevention databases
- Recover reasonable costs associated with the dispute, including legal fees
5. Shipping and Delivery
The Buyer acknowledges that:
- Shipping costs are in addition to the purchase price unless otherwise stated
- International shipments may incur import duties, VAT, or customs fees that are the sole responsibility of the Buyer
- A valid shipping address must be provided; the Artist is not responsible for shipments to incorrect addresses provided by the Buyer
- Signature is required on delivery for all works valued over $500; if the Buyer is unavailable to sign, the carrier’s standard redelivery process applies
- Risk of loss transfers to the Buyer upon confirmed delivery (carrier scan showing delivered and/or signature obtained)
6. Authenticity Guarantee
The Artist guarantees that the work described in this transaction is an authentic, original work by C.I. Gaspar (or, in the case of prints, an authorized reproduction produced under the artist’s direct supervision). A Certificate of Authenticity accompanies each work. If the work is found to be inauthentic at any point, the Artist will provide a full refund of the purchase price upon return of the work.
7. Copyright and Reproduction
The Buyer acquires ownership of the physical artwork only. All copyright, reproduction rights, and intellectual property rights remain with the Artist. The Buyer may not reproduce, distribute, license, or create derivative works from the artwork without written permission. The Buyer grants the Artist permission to use images of the artwork for portfolio, promotional, and educational purposes.
8. Condition and Care
The Buyer acknowledges that:
- Original works created with oil paint, gold leaf, mixed media, and alternative photographic processes require appropriate care and display conditions
- Works on paper should be displayed away from direct sunlight and excessive humidity
- Paintings with heavy impasto or metallic leaf should not be cleaned with solvents or abrasive materials
- The Artist is happy to provide care instructions specific to any work upon request
9. Resale Notification
As a courtesy, the Buyer agrees to notify the Artist if the work is resold, so that provenance records may be updated. This is a request, not a binding obligation, but maintaining provenance benefits the value of the work for all parties.
10. Anonymous Purchases
For anonymous purchases, this agreement applies in full. The Buyer’s identity is protected as described in the Terms of Sale and Privacy Policy. However, the payment processor (Stripe) maintains transaction records as required by law. The Artist does not have access to the Buyer’s name or financial details through Stripe unless voluntarily provided by the Buyer.
In the event of a dispute involving an anonymous purchase, the Artist will use transaction records, shipping tracking, and delivery confirmation as documentation. Anonymous Buyers have the same rights and obligations under this agreement as identified Buyers.
11. Governing Law
This agreement is governed by the laws of the State of Texas. Any legal proceedings arising from this agreement shall be conducted in the courts of Travis County, Texas.
12. Acceptance
By completing this purchase (clicking “Purchase,” “Place Order,” or “Pay Deposit”), the Buyer confirms that they have read, understood, and agreed to all terms in this Buyers Agreement, the Terms of Sale, and the Shipping Policy.
For inquiry-based purchases conducted via email, acceptance is confirmed by the Buyer’s written response (email or message) indicating agreement, followed by payment.
